Agreement to These Terms
These Terms govern your use of evolvedathlete.net and your registration for or attendance at any workshop, webinar, or event offered through this site by Evolved Athlete, a DBA of Odyssey Health ("we," "us," "our"). By using this site or registering for an event, you agree to these Terms. If you don't agree, please don't use the site.
What We Offer
Evolved Athlete provides coaching and education in applied neurology, nervous system regulation, flow state training, movement, and performance. This includes free and paid workshops, digital materials, and one-to-one coaching programs. Specific terms for any paid coaching program are set out in the separate agreement you receive before enrolling; these Terms govern this website and our workshops.
Health, Safety, and Assumption of Risk
Evolved Athlete is not a medical provider, and nothing here is medical advice. Brandon Day is a coach and applied neurology practitioner, not your physician. The content on this site and in our workshops is educational and is not a diagnosis, treatment, or a substitute for care from a licensed medical professional.
Our workshops include physical and neurological drills that you perform in your own body, unsupervised, in your own space. You participate at your own risk.
Consult a qualified healthcare provider before beginning any new physical, movement, or wellness practice — especially if you are pregnant, recovering from injury or surgery, or managing a cardiovascular, neurological, vestibular, or other medical condition.
Stop immediately if you feel pain, dizziness, nausea, or distress, and seek medical attention if symptoms persist. Never perform drills while driving or operating machinery. By participating, you accept full responsibility for your own safety and assume all risk of injury.
No Guarantee of Results
We share stories and examples from real people, and we're proud of them — but they are individual results, not promises. Outcomes depend on your starting point, your health, your consistency, and factors outside anyone's control. Nothing on this site should be read as a guarantee that you will experience any particular result.
Workshop Registration and Attendance
Registration is personal to you. Access links are for your use and shouldn't be shared or posted publicly. We may limit attendance, change the date or time, or cancel an event — if we do, we'll let registrants know by email at the address you registered with.
Where a workshop is offered at no cost, we may discontinue that at any time for future events. Where a fee applies, terms will be stated at the point of purchase.
Communications
When you register, you consent to receive emails and text messages relating to that event and our services. Message frequency varies, message and data rates may apply, and consent is not a condition of purchase. Reply STOP to unsubscribe from texts or HELP for help, and use the unsubscribe link in any marketing email. See our Privacy Policy for details.
Intellectual Property
All content on this site and in our workshops — including text, video, recordings, workbooks, frameworks, and the Evolved Athlete Method™ — is owned by Evolved Athlete and protected by copyright and other laws. You may use it for your own personal, non-commercial purposes.
You may not record, reproduce, distribute, resell, or publicly share workshop content or replays, or use any of it to build or train a competing program or product, without our written permission.
Content You Submit
"Your Content" means anything you send us or post through this site — including form responses, chat messages, questions asked during a workshop, and testimonials or reviews you choose to give us.
You keep ownership of Your Content. By submitting it, you grant us a non-exclusive, royalty-free licence to use, reproduce, and display it in connection with operating and promoting our services. If you give us a testimonial, that includes using it in marketing — and you can withdraw that permission for future use at any time by emailing us. Your Content must be yours to share and must not infringe anyone else's rights. We may remove any of it at our discretion.
Acceptable Use
Please don't use this site to break the law, interfere with its operation or security, scrape or harvest data, impersonate anyone, or submit false information. We may suspend or remove access for anyone who does.
Third-Party Links and Services
This site links to and relies on third-party services. We don't control them and aren't responsible for their content, availability, or practices.
Disclaimer of Warranties
This site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the site will be uninterrupted, error-free, or secure.
Limitation of Liability
To the fullest extent permitted by law, Odyssey Health, its DBA Evolved Athlete, and Brandon Day, together with their officers, directors, employees and contractors, will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of this site or participation in any workshop. Our total liability for any claim will not exceed the amount you paid us for the event giving rise to it, or one hundred US dollars, whichever is greater.
Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless Odyssey Health, its DBA Evolved Athlete, and Brandon Day from any claims, losses, or expenses arising out of your use of this site, your participation in a workshop, or your breach of these Terms.
Severability
If any provision of these Terms is found invalid or unenforceable, that provision is removed and the rest remain in full effect.
Assignment
We may assign, transfer, or subcontract our rights and obligations under these Terms without notice. You may not assign or transfer yours.
Entire Agreement
These Terms, together with our Privacy Policy, make up the entire agreement between you and us regarding this website and our workshops, and supersede any prior understandings. If you enrol in a paid coaching program, the agreement you sign for that program governs the program itself.
Governing Law and Jurisdiction
These Terms are governed by and interpreted under the laws of the State of Arizona, without regard to its conflict of law rules. You submit to the non-exclusive jurisdiction of the state and federal courts located in Arizona for the resolution of any dispute.
Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted here, and we'll update the date above. Continuing to use the site means you accept the updated Terms.
